Kesha has lost her case against Dr. Luke, despite all the support given to her. Dr. Luke is free from all charges from Kesha. A New York judge has discarded all seven charges the singer filed against Dr. Luke.
This is the second blow the singer has received as far as the case is concerned, and probably the most painful. Previously, the judge denied her request to be released from her contract with Sony Music. The judgment was made keeping in view the pledge of the label to allow her to work with other labels.
The case was dismissed because the judge, Shirley Werner Kornreich, stated that even if everything the singer has stated did occur, this did not happened in New York. The statute of limitation may have also passed, Buzzfeed pointed out.
Claims of Kesha that Dr. Luke raped her were also discarded. The judge mentioned that every rape cannot be a hate crime, and there is no evidence of that kind against him.
“Although Gottwald’s alleged allegations were directed at Kesha, who is female, the [counterclaims] do not allege that Gottwald harbored animus toward women or was motivated by gender animus when he allegedly behaved violently toward Kesha,” the judge stated.
While most of her claims were declined, her plea for clarification of rights with Sony is kept standing. The contract she signed is with RCA/Jive. Kesha is also denied the ability to amend her original complaint. The judge mentioned that her claim of emotional evidence did not have much evidence, too.
This is a sad day for the singer. Not only did she lost the case, Dr. Luke’s case of contract breach against her is still standing, as reported by CNN. Neither the representative of the singer or Dr. Luke was available for comments.
